These Terms of Service ("Terms") are a binding agreement between you ("User," "Client," "you," or "your") and National Consumers Right ("Company," "we," "us," "our," or "NCR"). By accessing and using our website www.nationalconsumersright.com (the "Site") and our services, you agree to be bound by all provisions of these Terms.
1. Acceptance of Terms
By using our Site and services, you acknowledge that you have read, understood, and agree to be bound by all provisions of these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you may not use our Site or services. Your continued use of our Site and services constitutes acceptance of these Terms.

You must be at least 18 years old and a resident of the United States to use our services. Our services are not available in all states and may be restricted or unavailable in your state. You represent and warrant that you have the legal right to enter into this agreement, that you meet all eligibility requirements, and that all information you provide is true, accurate, complete, and not misleading.

National Consumers Right provides consumer rights advocacy and financial solutions designed to help you protect your consumer rights and achieve financial stability. We offer:

- Financial planning and budgeting guidance
- Program administration and account management
Important: What We Do NOT Provide
- We do NOT assume, purchase, or pay your debts directly
- We do NOT make monthly payments to creditors on your behalf
- We do NOT provide tax, bankruptcy, accounting, or legal advice
- We do NOT provide credit repair services
- We do NOT guarantee specific outcomes
- We do NOT guarantee financial results within a specific timeframe
4. Fees and Payment Terms
You agree to pay all fees associated with our services as outlined in your individual service agreement or engagement letter. Payment terms may include:
- Setup fees for account establishment
- Monthly maintenance fees
- Settlement fees upon successful debt settlement
- Program administration fees
You are responsible for maintaining sufficient funds in your designated account, all charges and fees, applicable taxes, and any bank fees or charges incurred. Fees may be charged only upon successful settlement of your debts unless otherwise agreed in writing.
5. Your Responsibilities and Obligations
You agree to:
- Provide accurate and complete financial and personal information
- Update your information immediately if any changes occur
- Follow the terms and conditions of your debt settlement program
- Maintain regular contact with our representatives
- Not engage in fraudulent, deceptive, or illegal activities
- Comply with all applicable federal, state, and local laws
- Cease making payments to creditors as directed (when applicable to strategy)
- Save sufficient funds as instructed in your settlement account
6. Credit Impact and Legal Consequences
You understand and acknowledge that our services may have serious negative consequences:
- Our services will likely negatively impact your credit score and credit report
- Reduced or stopped payments to creditors may be reported to credit bureaus
- Creditors may file lawsuits against you for unpaid debts
- You may face wage garnishment or bank account levies
- Creditors may file judgments against you
- Collection agencies may pursue legal action
- Tax consequences may apply to forgiven or settled debt
- Your credit damage may persist for 7-10 years
You acknowledge that these consequences are inherent to the debt settlement process and you accept full responsibility. You should consult with a tax professional regarding potential tax liabilities from debt forgiveness and with a bankruptcy attorney regarding all available options.
7. Program Completion and Results
Important information about debt settlement results:
- Not all debts are eligible for enrollment in our program
- Not all clients successfully complete our program
- Clients who complete the program and settle all debts realize approximate savings of 45% before fees or 20% including our fees
- Settlement typically occurs over 12 to 48 months
- Savings estimates are based on prior results and will vary based on your specific circumstances
- Results depend on many factors including creditor cooperation, your financial situation, and market conditions
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- We are not liable for loss of profits, data, or use of data
- Our total liability shall not exceed the fees paid by you in the past 12 months
- We are not liable for third-party actions, including creditor lawsuits or collection efforts
- We are not liable for circumstances beyond our control or negligence of third parties
- We are not liable for any settlement terms or creditor actions
9. Dispute Resolution and Binding Arbitration
PLEASE READ THIS ARBITRATION AGREEMENT CAREFULLY. IT AFFECTS YOUR RIGHTS.
Any dispute arising out of or relating to these Terms, your use of our services, or any other matter related to our relationship shall be resolved by binding arbitration, EXCEPT for claims that cannot be subject to mandatory arbitration by applicable law. This includes contract disputes, tort claims, and statutory claims.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PURSUE CLAIMS AS A CLASS ACTION OR CLASS REPRESENTATIVE.
You agree to proceed on an individual basis, not as part of a class action, representative action, or consolidated proceeding. If you cannot bring a claim individually, the entire arbitration agreement shall be void and the dispute shall be resolved in court.
10. Call Recording and Monitoring
You acknowledge and consent to the recording and monitoring of all calls, communications, and interactions with our company for quality assurance, training, compliance, and dispute resolution purposes. These recordings are the sole property of National Consumers Right and may be retained and used as permitted by law. You waive any right to notice of recording to the extent permitted by law.
11. Communication Consent
By providing your phone number, email, or other contact information, you consent to receiving:
- Phone calls regarding your debt relief program
- Text messages about your account and services
- Emails regarding settlement updates and program information
- Other communications related to your enrollment
You may opt-out of certain communications by contacting us directly, except for communications necessary for program administration. Message and data rates may apply.
12. Children and Privacy
Our services are not directed to individuals under the age of 18. We do not knowingly collect or market to minors. If we become aware that a minor has provided information to us, we will delete such information immediately. Parents or guardians who believe their child has used our services should contact us immediately.
13. State-Specific Rights and Limitations
Certain states provide specific consumer protections. To the extent applicable:
- California residents have additional privacy rights under CCPA and other laws
- Wyoming residents are protected under state debt relief laws
- Other state residents may have specific protections under state law
- Services may be restricted or unavailable in certain states
These Terms and our services comply with all applicable state laws. If any provision is found to be unenforceable under state law, that provision will be modified to the minimum extent necessary to comply with state law.
14. Intellectual Property Rights
All content on our Site, including text, graphics, images, logos, and software, is the property of National Consumers Right or its content suppliers and is protected by international copyright and intellectual property laws. You may not reproduce, distribute, transmit, modify, or create derivative works of any content without our express written permission.
15. Prohibited Conduct
You agree not to:
- Violate any federal, state, or local law or regulation
- Provide false, misleading, or fraudulent information
- Engage in deceptive or unethical practices
- Harass, abuse, threaten, or intimidate our staff or other users
- Attempt to gain unauthorized access to our systems or accounts
- Interfere with Site functionality or server operations
- Reverse engineer, disassemble, or attempt to bypass security measures
- Collect or use personal information of others without consent
16. Disclaimer of Warranties
OUR SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF OUR SERVICES OR SITE CONTENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
17. Termination of Services
We may terminate or suspend your account and services immediately for: (a) violation of these Terms; (b) violation of applicable law; (c) providing false or fraudulent information; (d) non-payment of fees; or (e) any other reason at our sole discretion. Upon termination, your access to our services will cease, and you remain liable for all outstanding fees and obligations.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting an updated version on this page with an updated "Last Updated" date. Your continued use of our Site and services after modifications constitutes your acceptance of the modified Terms.
19. Entire Agreement
These Terms, along with our Privacy Policy and any service agreements or engagement letters, constitute the entire agreement between you and National Consumers Right regarding your use of our services and Site. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
20. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming, for any disputes that cannot be resolved through arbitration.
